Terms of Service

These Terms of Service ("Terms") govern your access to and use of the JobCare website, patient portal, clinician workspace, and related services (collectively, the "Services"). By creating an account or using the Services, you agree to these Terms.
1. About JobCare
JobCare operates a technology platform that connects members with independent, licensed clinicians for virtual urgent care, and supports the sponsoring employers that pay for the benefit. JobCare does not itself practice medicine or fill prescriptions. Clinical services are provided by independently licensed professionals who exercise their own professional judgment.
2. Eligibility
The Services are available to employees of a sponsoring employer that has purchased the JobCare benefit, and to their spouse and dependent children, who are covered at no additional cost. Eligibility is based on the employer's roster and begins on the employee's first day. You must be located in a U.S. state where the requested service is offered; care for minors is provided with the involvement of a parent or legal guardian.
3. Telehealth service limitations
- The Services are not for medical emergencies. If you are experiencing an emergency, call 911 or go to the nearest emergency room.
- Telehealth may not be appropriate for every condition. Clinicians may decline to treat, refer you to in-person care, or require additional testing at their sole discretion.
- Prescriptions and treatment plans are issued at the prescriber's sole clinical discretion. Use of the Services does not guarantee a prescription or a particular treatment.
- Controlled substances are not prescribed through the Services.
- The Services do not replace an employer's workers' compensation process for work-related injuries.
4. Patient accounts and accuracy
You agree to provide accurate, complete, and up-to-date information, including medical history, medications, allergies, and contact details. Providing false information may cause clinical harm and may result in termination of your account.
5. Cost to members
Visits are paid for by the sponsoring employer. Members are not charged for visits and are not billed by JobCare. Where a clinician sends a prescription to a member's local retail pharmacy, the member pays the pharmacy for the medication itself.
6. Employer-sponsored accounts
Where the Services are offered through an employer or other sponsoring organization ("Organization"), the Organization may configure roster-based eligibility, branding, and certain operational data. The Organization receives aggregate utilization reporting only and never individual health information. The Organization is responsible for its own use of the platform and for compliance with its agreements with members. JobCare's processing of PHI on behalf of an Organization is governed by the applicable Business Associate Agreement.
7. Acceptable use
- No misuse, reverse engineering, scraping, or unauthorized access of the Services.
- No sharing of accounts or impersonation of another person.
- No use of the Services to harass, threaten, or defraud others.
8. Intellectual property
The Services, including software, content, and branding, are owned by JobCare and its licensors. You receive a limited, non-exclusive, non-transferable license to use the Services for their intended purpose.
9. Disclaimers
THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. JOBCARE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY LAW.
10. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, JOBCARE WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUES, OR DATA, ARISING OUT OF OR RELATED TO THE SERVICES.
11. Indemnification
You agree to indemnify and hold JobCare harmless from claims arising out of your misuse of the Services or violation of these Terms.
12. Termination
We may suspend or terminate access to the Services at any time for any reason, including violation of these Terms or risk to patient safety.
13. Governing law and disputes
These Terms are governed by the laws of the state in which JobCare is incorporated, without regard to conflict-of-laws principles. Disputes will be resolved as set forth in a separately posted dispute-resolution addendum, where applicable.

15. Changes
We may update these Terms from time to time. Material changes will be posted here with a revised effective date. Continued use of the Services constitutes acceptance.
